Terms of Service

Last updated: 25 October 2026 · Version 1.0 · Edition: DigiSurvey Enterprise (Mumbai)

Enterprise commercial use. These Terms govern commercial use of DigiSurvey by insurance companies and IRDAI-licensed Surveyors & Loss Assessors. The service is sold on an enterprise basis; it is not a consumer product. Individual retail sign-ups are not supported.
  1. Parties. These Terms are between you (the enterprise customer, each “Customer”) and Digitaliiisla Technologies Private Limited, a company incorporated in India (CIN U62011RJ2026PTC119030), with its registered office at Khemi Sati Road, Jhunjhunu, Rajasthan 333001 (“Digitaliiisla”, “we”). The DigiSurvey platform is operated by Digitaliiisla.
  2. Scope. We make available a motor-insurance survey platform (the “Service”) that lets Customer users: (a) capture claim evidence (photographs, documents, GPS-stamped site visits, live-video calls); (b) run OCR and damage detection; (c) produce IRDAI-aligned survey reports; and (d) share those reports with the authorised insurer. The enterprise environment is hosted in Mumbai (ap-south-1) and is fully isolated from the digitaliiisla.co.in legacy environment.
  3. Permitted users. Only (a) insurance companies registered with IRDAI and their authorised employees or contractors; and (b) individual Surveyors & Loss Assessors holding a valid IRDAI licence under the IRDAI (Insurance Surveyors and Loss Assessors) Regulations, 2015, may be provisioned as users. Customer is responsible for ensuring that each user it onboards falls into one of these categories.
  4. Account security. Customer must keep user credentials confidential, enforce reasonable password policies, enable MFA where offered, and revoke access when a user leaves. Any action done through a Customer-provisioned account is attributed to the Customer. We may suspend any account we reasonably believe is compromised; we notify Customer within one business day of such suspension.
  5. Customer data; ownership. As between the parties, Customer owns all data it uploads or generates on the Service (“Customer Data”), including survey photographs, OCR text, assessments and final reports. We claim no title to Customer Data. We process Customer Data only to deliver the Service, under the Data Processing Addendum.
  6. No commercial reuse by us. We do not sell Customer Data. We do not use Customer Data to train commercial AI models for sale to third parties. We may use fully-anonymised, aggregated statistics (that cannot be reversed to a specific insured, surveyor or claim) to improve the Service and publish benchmarks.
  7. Service levels. Target monthly uptime for the enterprise environment is 99.5 %. Scheduled maintenance windows are notified at least 48 hours in advance. The full SLA, including credits, is published at /legal/sla.html and is applied on request.
  8. Fees. Fees are set in the Customer’s enterprise order form or SOW. Unless the order form says otherwise, fees are quoted in INR, exclude GST, are invoiced monthly in arrears and are payable net 30 days. We may charge interest at 1.5 % per month on overdue invoices after notice.
  9. Suspension for non-payment. If an invoice is overdue by more than 30 days we may suspend non-essential features (new sign-ups, bulk exports) after written notice. We will not delete Customer Data during suspension and we will not prevent read-only download of existing survey reports.
  10. Acceptable use. Customer and its users must comply with the Acceptable Use Policy. In particular, no scraping of other users’ data, no reverse engineering, no use for fraudulent claim fabrication, and no uploading of content that violates Indian law.
  11. Compliance with insurance law. Customer is responsible for ensuring that its use of the Service complies with the Insurance Act 1938, the IRDAI Act 1999, the IRDAI (Insurance Surveyors and Loss Assessors) Regulations 2015, the Motor Vehicles Act 1988, and all other applicable laws. The platform is a tool; the professional judgment reflected in each survey report is the surveyor’s own.
  12. Intellectual property. We retain all rights in the Service, including the software, the UI, the data model and the brand marks DigiSurvey and Digitaliiisla. Customer gets a non-exclusive, non-transferable right to use the Service during the term, within the fair-use volume stated in the order form.
  13. Confidentiality. Each party will keep the other’s confidential information in confidence and will use it only for the Service. This clause survives termination.
  14. Term and termination. The term is as stated in the order form, or month-to-month if not stated. Either party may terminate for material breach, uncured for 30 days after written notice. Either party may terminate immediately if the other becomes insolvent or loses a licence necessary for its performance.
  15. Data export on exit. On termination we give Customer 30 days of read-only access to export its data in machine-readable form (CSV, JSON, PDF reports in a ZIP). After that we delete Customer Data within 90 days, subject to statutory retention and legal holds, and provide written confirmation on request.
  16. Warranty. We will provide the Service with reasonable care and skill, consistent with industry practice. We do not warrant that the Service will be error-free or uninterrupted, or that it will fit any purpose beyond what is described in our documentation.
  17. Liability. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or exemplary damages, or for loss of profits, revenue, data or goodwill. Each party’s aggregate liability under these Terms is capped at the fees paid or payable by Customer in the 12 months before the event giving rise to the claim. These caps do not apply to (a) a party’s indemnity for IP infringement, (b) a party’s confidentiality breach, (c) fraud or willful misconduct, or (d) amounts due to be paid.
  18. Indemnity. Each party will indemnify the other against third-party claims arising from its own breach of law or of these Terms, subject to prompt notice, reasonable cooperation and sole conduct of defence by the indemnifying party.
  19. Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control, including natural disasters, strikes, regulator-ordered outages, backbone-ISP failures or acts of war — provided it gives prompt notice and resumes performance when possible.
  20. Changes. We may update these Terms. Material changes are notified at least 15 days in advance by email to the Customer’s billing contact and are posted at this URL. Continued use of the Service after the effective date is acceptance.
  21. Governing law and jurisdiction. These Terms are governed by Indian law. The courts at Jaipur, Rajasthan have exclusive jurisdiction over disputes, subject to mandatory arbitration under the Arbitration and Conciliation Act 1996 at the written election of either party.
  22. Grievance. A grievance under the DPDPA 2023 or the Information Technology Act 2000 can be raised with our Grievance Officer. We acknowledge within 72 hours.
  23. Notices. Legal notices to us go to legal@digitaliiisla.co.in with a copy to our registered office. Notices to Customer go to the billing contact on the order form or to the primary admin email on the Customer’s account.
  24. Severability. If any provision of these Terms is held unenforceable, the rest remain in force.
  25. Entire agreement. These Terms, together with the Customer’s order form, the DPA, the Privacy Policy and the Acceptable Use Policy, are the entire agreement between the parties for the Service.
